On August 27, 2022, at approximately 1:12 AM, Officers responded to a solo motorcycle collision in the 1100 block of Beaconsfield Road. 

During the investigation it was revealed that the involved driver was San José Police Department Officer Matthew Divina, a three-year veteran of the Department. Divina was off duty at the time of the incident; he was transported to a local hospital with non-life threatening injuries. During the investigation, Officers determined that Divina was driving under the influence of alcohol at the time of the collision. Due to being admitted to the hospital, Divina was not arrested on the day of the incident. 

The investigation was submitted to the Santa Clara County District Attorney's Office, and on December 26, 2022, Divina was charged with misdemeanor driving under the influence of alcohol and an arrest warrant was issued. On December 29, 2022, Divina self-surrendered and was issued a court date for the offense.

This is now an internal administrative and criminal investigation, and additional information is not available.

"I have no tolerance for behavior that does not align with the values of the San José Police Department and will hold employees accountable when there is a violation of the law or a breach of Department policy,” said Chief of Police Anthony Mata.
