On September 19, 2023, patrol Officers responded to a business in the 400 block of E. Santa Clara Street in response to a report of a felony sexual assault. During the investigation, it was revealed that the suspect entered a business and assaulted a lone employee.
Patrol Officers conducted the preliminary investigation and Sexual Assault Investigation Unit detectives responded to the scene. With the combined efforts of patrol officers and detectives, SJPD was able to collect evidence that led to the identification of Miguel Rivera as the primary suspect.
Once SAIU detectives took over the investigation they obtained an arrest warrant for the suspect and a search warrant for his residence.
On September 20, 2023, the suspect was arrested in the city of San José and booked into Santa Clara County Main Jail for assault with intent to commit a felony, kidnapping to commit a sexual offense, attempted robbery, assault with force likely to produce great bodily injury, battery causing great bodily injury, and false imprisonment.
