On August 12, 2023, at approximately 11:07 pm, Officers from the San José Police Department responded to the 1500 block of Huddersfield Court for a report of an infant female who was not conscious and not breathing. The infant victim was later pronounced deceased at the scene. Per Santa Clara County protocol for all child deaths, the case was turned over to the San José Police Department Homicide Unit.

During the course of the investigation, Homicide Detectives found both the father, Derek Rayo, and mother, Kelly Richardson, as the primary suspects responsible for the death of the infant victim. Detectives discovered evidence suggesting both suspects knowingly left various illegal and dangerous drugs around the infant victim.

On November 2, 2023, Homicide Detectives were informed by the Santa Clara County Coroner's Office that a lethal concentration of fentanyl was found in the victim's blood. Homicide Detectives later convened with the Santa Clara County District Attorney's Office and worked together to obtain homicide arrest warrants for both suspects.

Suspect Rayo, who has been in custody since August 13, 2023 for an unrelated warrant, was served with the homicide warrant on November 21, 2023. Suspect Richardson was arrested by SJPD's Covert Response Unit (CRU) on November 22, 2023 in San José.

The identity of the victim will be released by the Santa Clara County Coroner’s Office after confirming the victim’s identity and notifying next of kin.

This was the City's 30th homicide of 2023.
