On November 11, 2023, San José Police Department Officers responded to a road rage incident that occurred in the area of Capitol Expressway and Tully Road. The preliminary investigation revealed the following:

A suspect vehicle occupied by two unidentified adult males initiated a road rage incident with a victim vehicle driven by an adult male and occupied by an adult female and two dogs. While at a red light, a third adult male driving a second suspect vehicle exited his vehicle, then proceeded to jump onto the car and smash the rear windshield. The shattered glass fell into one of the dog's eyes, prompting emergency medical care.

The San José Police Department Assaults Unit took over the investigation and with the assistance of the Crime Data Intelligence Center (CDIC), identified Armando Cano as the primary suspect responsible for smashing the rear windshield and critically injuring the dog.

Assaults Unit Detectives obtained an arrest warrant for the suspect, and on November 22, 2023, suspect Cano was arrested in the city of San José and booked into Santa Clara County Main Jail for felony vandalism, battery, and animal abuse.
