On January 18, 2024 patrol Officers responded to a report of an armed robbery that occurred in the 1000 block of Leigh Avenue and on January 19, 2024, patrol Officers responded to a separate report of an armed robbery that occurred in the 800 block of West San Carlos Street in San José. San José Police Department Robbery Unit Detectives followed up on the incidents and conducted a thorough and comprehensive investigation. Detectives determined the suspect vehicle was associated to a burglary that occurred in the city of Santa Clara. Detectives identified the suspect as Dylan Tonery.
SJPD Robbery Unit Detectives discovered the suspect was arrested on January 24, 2024, by the Santa Clara Police Department in connection to their burglary. Detectives obtained a search warrant for the suspect's vehicle and located evidence connecting him to the two armed robberies that occurred in San Jose.

On February 9, 2024, the Santa Clara County District Attorney's Office filed charges that included robbery and gun enhancements. The suspect remained in custody.
