On August 9, 2018, at approximately 10:16 PM, San José Police Department Officers responded to multiple calls of a shooting at La Victoria Taqueria located at 5015 Almaden Expressway in San José. Arriving Officers located three adult male victims outside the restaurant suffering from at least one gunshot wound each. All three victims were taken to a local hospital for treatment.

The preliminary investigation revealed the victims and two adult male suspects were inside the restaurant when they became involved in an argument. The group walked outside with the primary suspect who produced a handgun and shot the three victims. During the shooting, multiple bystanders were nearby, including a small child who was standing next to the primary suspect.

On September 5, 2018, SJPD released a surveillance video of the incident in an effort to request the public's assistance in identifying the suspect.

On November 13, 2023, San José Police Department Homicide Detectives proactively re-opened the case after developing new leads. During the investigation, Homicide Detectives identified Miguel Vergara Perez as the primary suspect responsible for the attempted murder. 

SJPD Homicide Detectives obtained an arrest warrant for the suspect and on December 12, 2023, the SJPD Covert Response Unit arrested suspect Vergara Perez in the city of Rohnert Park. The suspect was taken into custody and booked into Santa Clara County Main Jail for attempted homicide.
