On February 15, 2024, at approximately 3:59 AM, San José Police Department Patrol Officers responded to a local hospital for a report of a suspicious circumstance. When Officers arrived, they discovered an adult male victim with non-life threatening injuries who self-transported to the hospital. The preliminary investigation revealed the following:
On the evening of February 13, 2024, the adult male victim was kidnapped and held against his will in the 2600 block of Million Court. Multiple suspects held the victim against his will and tortured and assaulted him multiple times. The victim was eventually released by the suspects.
SJPD Robbery Unit Detectives conducted a thorough and comprehensive investigation and identified Duc Nguyen, Kim Ho, and Dayton Pham as the suspects responsible for the kidnapping and torture.
During the investigation, Detectives determined that suspect Nguyen was also responsible for an assault with a deadly weapon and criminal threats incident that took place on February 14, 2024 at a business located in the 3000 block of Story Road. In addition, it was discovered that suspect Nguyen was also a primary suspect for an organized retail theft string being investigated by the Santa Clara County Sheriff’s Office.
SJPD Detectives obtained arrest warrants for all three suspects and search warrants for their respective residences. On April 9, 2024, the SJPD Covert Response Unit (CRU) and Special Operations MERGE Unit executed the search warrants and apprehended the three suspects.
During the execution of the search warrant, Detectives seized evidence related to the crime, but also located illegal gambling machines and illegal marijuana for sale.
Suspects Pham and Ho were arrested in the city of San José and suspect Nguyen was arrested in the city of Sunnyvale. All three suspects were booked into Santa Clara County Jail for multiple crimes including robbery, kidnapping, torture, and assault with a deadly weapon.
