On May 9, 2024, at approximately 5:46 PM, San José Police Department Patrol Officers responded to a report of a shooting at an unhoused encampment in the area of Mclaughlin Avenue and HWY 280. When Officers arrived, they located an adult male victim suffering from at least one gunshot wound. The victim was transported to a local hospital where he was stabilized but remained in critical condition. The suspect fled the scene prior to police arrival. During the preliminary investigation, Patrol Officers immediately identified the suspect as Joseph Martinez.

On May 12, 2024, SJPD was notified that the victim had succumbed to his injuries and was pronounced deceased at the hospital.

SJPD Homicide Unit Detectives began a thorough and comprehensive investigation. On October 31, 2024, Detectives were notified that suspect Martinez was arrested and booked into Washoe County Detention Facility in the city of Reno for an unrelated crime.

On November 21, 2024, Detectives extradited suspect Martinez back to the city of San José and booked him into Santa Clara County Main Jail for murder.

The motive and circumstances surrounding the incident are under investigation.

The identity of the victim will be released by the Santa Clara County Coroner’s Office after confirming the victim’s identity and notifying next of kin.

This was the City's 13th homicide of 2024.
