On July 21, 2024 at approximately 10:00 AM, Officers responded to a report of a weapons disturbance located in the 1300 block of Dubert Lane. Four unknown male suspects threatened the adult male victim. One suspect brandished a machete, a second suspect brandished a knife and the third suspect brandished a firearm. When another resident arrived, the suspects fled the area in a vehicle. Approximately five minutes later, the suspects returned and fired multiple rounds toward the victim's residence. One round entered a second victim’s residence, striking their mattress while they slept. That round narrowly missed the second victim's head.
During the course of the investigation, Patrol Officers identified the suspect vehicle and located it in the area of Story Road and King Road. A high risk enforcement vehicle stop was conducted and the driver was taken into custody. The driver was identified as Victor Gonzalez and was determined to be one of the suspects responsible for the incident.
During the preliminary investigation, the incident was determined to be gang-motivated. The San José Police Department Gang Investigations Unit (GIU) Detectives immediately began a thorough investigation. Detectives identified Ruben Gonzalez and Francisco Mercado as suspects. With the assistance of the Santa Clara County District Attorney’s Office, Detectives and Patrol Officers obtained arrest warrants for the suspects and search warrants for their associated residences.
On October 2, 2024, GIU Detectives, with the assistance of the Covert Response Unit (CRU), apprehended suspect Ruben Gonzalez. On January 15, 2025, suspect Francisco Mercado was taken into custody and the residential search warrants were served. Suspects Corrina Namuleg and Timothy Nelson were observed removing a bag from the residence. When Officers detained them, they discovered the bag possessed firearms inside. They were taken into custody for conspiracy and possession of illegal firearms.
During the execution of the residential search warrants, eight firearms were recovered which included a combination of registered and unregistered firearms. Three firearms were privately manufactured. Additionally, one machete and multiple rounds of ammunition were also recovered. All suspects were booked into the Santa Clara County Main Jail for multiple felony charges.
