The City of San Jose Police Department will be conducting a DUI/Drivers License checkpoint on Saturday, March 15, 2008 from 9:30 p.m.to 3:30 a.m., at East Santa Clara Street and Fifth Street in San Jose. A DUI checkpoint is a proven effective method for achieving this goal. By publicizing these enforcement and education efforts, the City of San Jose Police Department believes motorists can be deterred from drinking and driving.
Traffic volume and weather permitting, all vehicles may be checked and drivers who are under the influence of alcohol and/or drugs will be arrested. The Hardings felt that "Something must be done to help prevent the estimated 6,000 teenage deaths that occur each year in the U.S. as a result of reckless driving." Starting Maxwell's Pledge was something they felt compelled to do following the loss of their son.

San Jose Police Department Targets
Impaired Drivers with Checkpoint
The City of San Jose Police Department will be conducting a DUI/Drivers License checkpoint on Friday, May 23, 2008 from 9:00 p.m. to 3:00 a.m., at Monterey Road and Fehren Drive in San Jose. In an effort to reduce the number of persons killed and injured in alcohol involved crashes, DUI checkpoints are conducted to identify offenders and get them off the street, as well as educate the public on the dangers of impaired driving.
All too often, members of our community are senselessly injured or killed on local roadways by impaired drivers. This DUI/Drivers License checkpoint is an effort to reduce those tragedies, as well as insuring drivers have a valid driver's license. A major component of these checkpoints is to increase awareness of the dangers of impaired driving and to encourage sober designated drivers.
Our objective is to send a clear message to those who are considering driving a motor vehicle after consuming alcohol and/or drugs - Drunk Driving, Over the Limit, Under Arrest. The public is encouraged to help keep roadways safe by calling 911 if they see a suspected impaired driver.
Funding for this operation is provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.
Inquires can be directed to Sgt. Paul Woo at 408-277-4341.
Note: If inclement weather occurs the location will change to South First Street and Hwy 280 in San Jose.

Out of Tragedy Comes Safety Program for Teens
San Jose: Maxwell's Pledge, a new peer-to-peer program for teens that promotes and supports safe driving behavior today (Tuesday, May 27, 2008) is being launched by a unique community partnership between the family of Maxwell Harding, and American Medical Response (AMR), with support from the San Jose Police Department (SJPD). Max Harding, a passenger in the car, died tragically last July in a four-person fatal accident on Graystone Lane in Almaden Valley. The program was launched at Leland High School, where Max graduated from just about a year ago.
"Starting Maxwell's Pledge was something we felt compelled to do, following the loss of our son," explains Martin Harding. The Hardings decided that, "Something must be done to help prevent the estimated 6,000 teenage deaths that occur each year in the U.S. as a result of reckless driving – most of which are entirely preventable."
The idea initially took shape while the Hardings were searching for an organization to designate for donations in memory of Max. They tried to find a local program for teens that promotes safe driving behavior, but couldn't find one.
So Jo and Martin Harding took their idea for action straight to San Jose Police Chief Rob Davis. Davis immediately saw that this was something that could make a difference. After meeting with several of the Chief's staff, the program quickly took shape under the direction of Lt. Jeff Smith, who heads up SJPD's Traffic Enforcement Unit.
According to the Chief, "Getting the attention of teen drivers is the key to solving this tragic loss of young lives in our community, and our goal is to eventually see this program rolled out in all our high schools," stated Davis. With the help of San Jose Police, a logical community partnership was identified by teaming up with the Choices program. Choices was developed by American Medical Response (AMR) in 1995 to help teens make good decisions about many of the situations they face in their lives.
"The decision to drive safely is an important choice that teens can make and AMR is proud to incorporate this innovative new program into our Choices curriculum," stated Virginia Jones, Community Education Coordinator, with AMR. Working with students from Leland High School, officials developed Maxwell's Pledge based on input from the teens, many of whom knew Max.
Maxwell's Pledge is a grass roots program that encourages teenage drivers to take more responsibility for their own safety, and the safety of others, by recognizing that every time they get behind the wheel of a vehicle, they are in control of the safety of their passengers, other motorists and themselves. Ultimately, they need to realize that they are driving a very dangerous piece of equipment which has great capacity to cause harm.
By voluntarily signing Maxwell's Pledge, each student agrees to be a responsible driver. The Pledge decal displayed on their vehicle becomes a constant reminder to all that teenage drivers care about safety and don't let friends hurt friends.
Most teens, if asked, will tell you that they have been scared while driving with their peers and many will admit to having been involved in a crash at some point. However, many teens also admit they are hesitant to speak up in this type of situation, even when they have felt the need to do so.
For teens, when it comes to the new experience of driving, there is a tremendous amount of peer pressure to go along with the crowd and be cool. Teen peer pressure can actively encourage unsafe driving, or it may be passive by simply not speaking up when an unsafe situation is developing. Either way, there is often only a brief moment when the right encouragement to the driver may well prevent a disaster.
In addition to AMR (www.AMRChoices.org) and the San Jose Police Department, the program was developed in collaboration with Leland High School students, the City's Transportation Department, the Street Smarts program (www.GetStreetSmarts.org), and the Santa Clara County Traffic Safe Communities Network.

San Jose Police Department and the Family Violence Unit want to remind parents, guardians and babysitters to take extra care with little ones this year.
Media Advisory
"Summertime Safety"
DETAILS:
With Summer vacation just around the corner, the San Jose Police Department and the Family Violence Unit want to remind parents, guardians and babysitters to take extra care with little ones this year. Tragic reminders surround us every day:
-
In 2006, San Jose Police Officers investigated 15 cases of children falling out of second-floor windows;
-
Officers have responded to numerous complaints from concerned citizens about children left in locked cars in sweltering heat;
-
In the past several years, San Jose Police Officers have investigated numerous drownings or near-drownings of children, some as old as 11 years of age.
-
In April 2002, San Jose Police Officers removed two small children, one 3-years-old and one 10-months-old, who were locked in a car. The officers estimated the interior temperature of the vehicle to be 100 degrees. The father was shopping at a nearby commercial center.
-
In May 2000, San Jose Police Officers removed a two-year-old from a car when the child was found by a passer-by. The child's mother was shopping at Eastridge Mall in east San Jose.
-
In June 2000, San Jose Police Officers removed a three-year-old from a car when the child was found by a passer-by. The outside temperature was 83 degrees and the inside temperature of the car was well over 100 degrees. The child's mother was shopping at Westgate Mall in west San Jose.
-
In the past three years, we have seen children drown in bathtubs and in home or apartment swimming pools.
Many of these cases have resulted in criminal charges being filed against the parent or guardian. The most tragic scenario is a parent, guardian or babysitter living a lifetime of regret over an injury or death that could easily have been prevented.
The San Jose Police Department reminds parents, guardians and babysitters to make good decisions this summer. Know where your children are. If you have to leave them, even momentarily, make sure that someone else is watching them for you. It takes only an instant to change a young life, or yours... forever...

A major component of these checkpoints is to increase awareness of the dangers of impaired driving and to encourage sober designated drivers.
Our objective is to send a clear message to those who are considering driving a motor vehicle after consuming alcohol and/or drugs - Drunk Driving, Over the Limit, Under Arrest. OPERATION SAFE PASSAGE
During the school week of September 15-19, 2008, the San Jose Police Department, California Highway Patrol and all law enforcement agencies in Santa Clara County will be participating in a countywide, school safety program known as "OPERATION SAFE PASSAGE."
The purpose of this operation is to alert and educate the community that traffic safety and the rules of the road DO apply and will be strictly enforced. The most important point of this project is to develop a safe and long lasting attitude among the communities near school zones.
Enforcement efforts will focus on:
-
Parents transporting their children
-
Commuters
-
Children walking and riding their bicycles to school
Each day during this enforcement week the San Jose Police Department will partner with allied agencies throughout the county to saturate school zones within each agency's jurisdiction. Several teams of officers from each agency will be deployed to different regions of the county to enforce traffic laws for the purpose of education and enforcement. The enforcement teams will concentrate on the following hazardous violations near school zones:
-
Failing to stop for school buses displaying flashing red stop lights
-
Speeding vehicles
-
Failing to yield to pedestrians
-
Jaywalking
-
Bicyclists failing to wear a safety helmet
-
Child restraint and seat belt violations
-
Other collision-causing violations such as running stop signs, etc.
The City of San Jose Parking Control Officers will also take part in the enforcement efforts.
Inquiries may be directed to Sgt. Paul Woo of the San Jose Police Department Traffic Enforcement Unit, at (408) 277-4341.

San Jose Police Department Targets
Impaired Drivers with Checkpoint
The City of San Jose Police Department will be conducting a DUI/Drivers License checkpoint on Friday, September 26, 2008 from 9:00 p.m. to 3:00 a.m., at an undisclosed location in San Jose.

San Jose:

On September 18, 2008, the San Jose Police Department began investigating an allegation of sexual battery by Dr. Benva Lazar. The victim accused Dr. Lazar of fondling her breasts while she was receiving a dental examination at his office located at 5710 Cahalan Ave. #9.
Dr. Lazar expressed concern to the victim about her health and the rise in cancer diagnoses. He then carried out what he represented was a medical breast examination on the victim and emphasized the importance of self-examinations.
On October 30, 2008, Dr. Lazar was arrested and booked into the Santa Clara County Jail for a felony arrest warrant for "Sexual Battery by fraudulent representation that the touching served a professional purpose." During the course of the investigation, detectives learned that Dr. Lazar may have performed breast examinations on other patients.

Joint Media Advisory
JOINT PRESS EVENT - SAN JOSE POLICE & SAN JOSE POLICE FOUNDATION
DONATION OF 3 SEGWAYS TO PATROL DOWNTOWN
Date: Monday, November 3, 2008
Time: 2:30 PM
Location: 101 Paseo de San Antonio in front of the San Jose Repertory Theatre

In an ongoing effort to keep the San Jose community safe, the San Jose Police Department will be the first major city in Northern California to patrol the downtown area with the Segway personal transporters. Three Segways will be donated to the San Jose Police Department by the San Jose Police Foundation, the non-profit organization started in 2006 by community members and supported by Chief Robert L. Davis. Segways have been used successfully at the Mineta San Jose International Airport since 2005 and we were the first in California to use the transporters. The Segways will be primarily used by the Police Department's Downtown Services Detail (DSD) to help patrol the downtown area on weekend evenings.
The Segways, which cost about $6,000 each, provide a great opportunity for the San Jose Police Department to be seen by the public as the officers are more visible during their patrols. The riding platform is 8 inches high at the base and allows citizens to approach the officers in the true spirit of community policing. The Segways patrolling Downtown will also provide a visible deterrent in an effort to curb criminal activities. The Segways can travel at a maximum speed of 12 mph. After a full charge, which will cost only 10 cents, the Segways have the ability to travel up to 24 miles. This will further support Mayor Reed's Green Vision Goal for San Jose.
The Foundation hopes to fund the purchase of 2-3 additional Segways next year after they host their marquee fundraiser, Bowling for Badges, which raised over $50,000 during last years event. The next Bowling for Badges event will take place on May 14, 2009 and is open to businesses who wish to bowl and compete in an effort to further support the foundation's goals in keeping the citizens of San Jose safe.
Chief Robert L. Davis will be joined by the president of the Foundation, Leigh Weimers, and other Foundation board members to say a few words about the positive work of the Police Foundation and the goals to support public safety. Please join Chief Davis and Leigh Weimers to observe the Segways in action by the DSD officers.

"San Jose Police Department Enforcing Seat Belts During Holidays"
Click It or Ticket Campaign Aims For Safe Thanksgiving
San Jose, Calif. - The San Jose Police Department, in an effort to help bring everyone home safe for the holidays, will be aggressively enforcing the state's seat belt and child safety seat laws during a Click It or Ticket mobilization, taking place November 17-30, 2008.
The campaign relies on heavy enforcement and public education as a means to help reduce deaths and injuries on California roadways. California currently has a seat belt use rate of 95.7%.
California has a primary seat belt law which requires that every passenger in the car, including the driver, is required to wear a seat belt at all times. If stopped and found to be in violation, law enforcement will issue citations without warning. Tickets for first seat belt violations range from $80 to $91 for adults and $330 to $401 for children under age 16, depending on the county.
"While we are very happy with actually surpassing 95% usage, that still means that more than a million people are in real danger in the event of a crash," said Christopher J. Murphy, Director of the Office of Traffic Safety (OTS). "It takes just two seconds to reduce your chances of dying in a crash by half."
Teens and nighttime car occupants lag behind others as far as buckling up is concerned. Officers will be concentrating even more on ensuring they are properly restrained. More than 280 law enforcement agencies statewide will be participating in this year's Click It or Ticket mobilization.
Funding for officer overtime to support California's Click It or Ticket campaign was provided by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

Press Conference
Date: November 14th, 2008
Time: 11:00 AM
Location: Community Services
1671 The Alameda, Suite 100, San Jose, CA 95126
The San Jose Police Department's Crime Prevention Unit has been awarded a monetary grant for the purchase of Skate helmets from Target. In May 2008, Community Services received information from Target staff about Target & Blue 2008 Law Enforcement Grant Program. The focus areas of this grant were crime prevention, training and education, community outreach/youth mentorship, preparedness and organized retail crime.
The staff of the Crime Prevention Unit thought about a program which could benefit from the grant funds. The project/program created was "Safe Skull Skaters"- a program to provide safety helmets to economically disadvantaged youth using public skating parks in the City of San Jose. Crime Specialist Sonja Azevedo was given the task of writing the grant. In October, the Crime Prevention Unit learned it had received the grant.
The Crime Prevention Unit is extremely grateful to Target and it's commitment to assisting the San Jose Police Department in making the City of San Jose a safer place to live. The Crime Prevention Unit plans on distributing skate helmets at the grand openings of the two new skate parks, Mayfair and Roosevelt very soon.
Anyone with questions about the conference may contact Officer Catherine Unger of the San Jose Police Department's Community Services Office at (408) 277-4133

Impaired Drivers with Checkpoint
The City of San Jose Police Department will be conducting a DUI/Drivers License checkpoint on Saturday, December 13, 2008 from 9:00 p.m. to 3:00 a.m., at an undisclosed location in San Jose.

San Jose:
On Monday, December 29, 2008, the Santa Clara County District Attorney's Office issued a criminal complaint charging Julio Morales with false imprisonment and sexual battery. Morales is a San Jose police officer, and the alleged offenses occurred while he was on duty.
Police department investigators immediately began an investigation on the evening of December 3, 2008, when a relative of the eighteen year-old victim called the Department to complain about the young woman's encounter with an officer earlier that same evening. In her account to investigators, she reported being detained by a patrol officer as she walked in the area of South Third and Keyes Streets in San Jose. She described that during the encounter, the officer touched her inappropriately during a pat-search, then drove her to a nearby home where he left her.
The investigation led to the identification of Julio Morales as the officer the victim described. Morales is a thirteen-year veteran of the Department, who was serving as a uniformed patrol officer until being placed on administrative leave during the investigation. Morales surrendered himself to the Santa Clara County Sheriff's Department on 12-30-08 and was released on bond.
In an effort to determine if there may be other potential victims, or if someone has additional information in this case, the Department requests that contact be made with Lt. Mark McIninch of the San Jose Police Department's Sexual Assault Investigation Unit at 408-277-4102. Persons wishing to remain anonymous may call Crime Stoppers at 408-947-STOP.
